Version: 2.0

IMPORTANT

Please read these Terms & Conditions carefully before making a booking.

These Terms & Conditions (“Terms”) apply to all programmes, activities and services provided by Island Sports Limited trading as Island Sports (“Island Sports”, “we”, “us” or “our”), including public classes, term programmes, drop-in classes, private coaching, swimming, gymnastics, multisports, sport-specific programmes, school programmes and ECAs, holiday camps, birthday parties, events and academies.

For the purposes of these Terms, “Island Sports Personnel” means, where applicable, the directors, officers, employees, coaches, instructors, contractors, consultants and authorised representatives of Island Sports Limited acting in connection with an Island Sports programme.

The person making a booking (“Parent/Guardian”) confirms that they are the participant's parent or legal guardian, or otherwise have lawful authority to register the participant and provide the consents contained in these Terms.

By completing the required acceptance process when booking, the Parent/Guardian agrees to these Terms.

1. BOOKINGS & PAYMENT

1.1 A place is not confirmed until the booking has been accepted by Island Sports and the required payment has been received.

1.2 Places are subject to availability and are generally allocated on a first-come, first-served basis.

1.3 Unless expressly stated otherwise, fees paid to Island Sports are generally non-refundable, subject always to any rights or remedies that cannot lawfully be excluded.

1.4 Different cancellation, rescheduling, credit and transfer arrangements may apply depending on the programme booked. Any programme-specific conditions communicated at or before booking form part of these Terms.

1.5 Island Sports may offer packages, promotional prices, discounts or promotional codes from time to time. These are subject to their stated conditions and cannot be exchanged for cash.

1.6 Parents/Guardians are responsible for checking the programme, participant information, dates, times and locations before completing a booking.

1.7 Island Sports may refuse or cancel a booking where reasonably necessary for safety, safeguarding, programme suitability, non-payment, serious misconduct or operational reasons.

2. PROGRAMME-SPECIFIC REQUIREMENTS

2.1 Certain programmes may be subject to additional safety, supervision, equipment, clothing, collection, medical, venue or participation requirements.

2.2 These requirements may be communicated at booking, before participation or through a programme-specific policy or notice.

2.3 Programme-specific requirements communicated to the Parent/Guardian form part of the conditions of participation.

2.4 Where a programme is delivered at a school or third-party venue, applicable site rules and operational requirements may also apply.

3. PUBLIC TERM CLASSES

3.1 Term bookings reserve a participant's place for the applicable programme.

3.2 Missed sessions resulting from holidays, personal scheduling conflicts, non-attendance or other circumstances personal to the participant are not ordinarily refundable.

3.3 Any sick-leave, make-up, transfer or rescheduling entitlement applicable to a particular package will be stated at or before booking.

3.4 Make-up sessions and transfers, where permitted, are subject to availability.

3.5 Unused sessions expire at the end of the applicable package or programme period unless Island Sports expressly agrees otherwise.

4. DROP-IN CLASSES

4.1 Drop-in bookings are subject to availability.

4.2 Any permitted cancellation or transfer must be completed within the cancellation period displayed at booking.

4.3 Late cancellations and non-attendance are non-refundable, subject to applicable law.

4.4 A permitted transfer remains subject to availability and does not guarantee a place in another session.

5. PRIVATE LESSONS

5.1 Following any introductory or trial lesson, recurring private time slots may require the purchase of an applicable package.

5.2 Island Sports cannot guarantee that a regular time slot will remain available where the required package has not been purchased.

5.3 Private lessons are appointment-based. Missed appointments and late cancellations are ordinarily non-refundable.

5.4 Rescheduling rights, including any applicable notice period or medical exception, will be communicated with the applicable package.

5.5 Private lesson packages must be used within their stated validity period.

5.6 Admission fees, parking charges, venue fees or other expenses specifically incurred in providing a private lesson may be charged to the customer where disclosed or reasonably applicable.

6. CAMPS

6.1 Camp bookings are generally non-refundable unless otherwise stated at or before booking, subject to applicable law.

6.2 Missed camp days resulting from illness, holidays, personal scheduling or non-attendance are not ordinarily refundable.

6.3 Any transfer, credit or exceptional cancellation arrangement offered by Island Sports is subject to availability and the conditions applicable to the particular camp.

6.4 Island Sports may, at its reasonable discretion, consider exceptional circumstances. An exception in one case does not create an entitlement to the same treatment in another case.

6.5 Camp programmes may include sports, games, water-based activities, meal and rest periods, movement between activity areas and other age-appropriate recreational activities described in the programme.

6.6 Published camp schedules are indicative. Activities may be substituted, rearranged or modified according to participant needs, weather, venue availability, staffing, group size or safety considerations.

6.7 Parents/Guardians must provide any requested emergency contact, medical, authorised collection, food, drink, clothing and equipment information before attendance.

7. BIRTHDAY PARTIES & PRIVATE EVENTS

7.1 Birthday parties and private events are subject to the package and booking conditions agreed at confirmation.

7.2 Unless Island Sports is providing the venue, the booking party is responsible for ensuring that an appropriate and lawful venue is available.

7.3 The booking party must ensure that Island Sports has sufficient access for reasonable setup and that the activity area is reasonably suitable for the booked programme.

7.4 Final participant numbers must be provided by any deadline specified in the booking confirmation.

7.5 Significant increases in participant numbers may require additional coaches, equipment or charges and remain subject to availability.

7.6 Costs incurred for customised equipment, party props, third-party services or specifically purchased materials may be non-refundable once ordered.

7.7 Cancellation and rescheduling deadlines applicable to the party will be confirmed at booking.

7.8 Coaches may reasonably adapt games, activities and timings according to participant ages, abilities, group size, weather, venue space and safety considerations.

7.9 Island Sports may decline or stop an activity where the available venue, participant numbers or other circumstances make the planned activity unsafe or materially unsuitable.

8. CANCELLATIONS & CHANGES BY ISLAND SPORTS

8.1 Island Sports may cancel, relocate, postpone or modify a programme where reasonably necessary because of:

unsafe weather or environmental conditions;
venue closure or unavailability;
government warnings or restrictions;
coach illness or unexpected staff unavailability;
insufficient enrolment;
safety or safeguarding concerns; or
circumstances reasonably outside Island Sports' control.

8.2 Island Sports will endeavour to inform affected customers as soon as reasonably practicable.

8.3 Where Island Sports cancels a session, it may offer an appropriate replacement session, rescheduling opportunity or account credit.

8.4 Where Island Sports cancels a paid programme for reasons within its reasonable control and cannot provide a reasonable alternative, an appropriate refund for the affected service may be provided.

8.5 Nothing in this section limits any refund or remedy required by applicable law.

9. WEATHER, HEAT & ENVIRONMENTAL CONDITIONS

9.1 Participant safety takes priority when determining whether a programme should proceed or continue.

9.2 Outdoor programmes may be modified, relocated, postponed or cancelled because of rain, thunderstorms, extreme heat, typhoons, poor air quality or other unsafe environmental conditions.

9.3 Indoor programmes may also be affected by government warnings, venue requirements, transport disruption or other safety considerations.

9.4 Island Sports Personnel may reduce activity intensity, introduce additional rest or hydration breaks, alter activities, relocate activities or stop a session where reasonably considered necessary for participant safety.

9.5 Where a school or venue requires activities to cease or be modified, Island Sports will comply with applicable venue requirements.

9.6 Programme-specific weather arrangements may be communicated separately.

10. AGE, ABILITY & GROUP PLACEMENT

10.1 Programme age ranges and ability levels are intended to support safe and developmentally appropriate coaching.

10.2 Island Sports may assess a participant and recommend or require movement to another group or level where reasonably necessary for safety, developmental appropriateness, participant confidence, coaching effectiveness or the overall operation of the group.

10.3 Placement decisions may take into account age, physical ability, swimming competency, confidence, previous experience and other relevant considerations.

10.4 Parents/Guardians may discuss placement decisions with Island Sports. Final operational decisions concerning safe participation and group placement remain with Island Sports.

11. CLOTHING, FOOTWEAR & EQUIPMENT

11.1 Participants must attend in clothing, footwear and protective equipment reasonably appropriate for the activity.

11.2 Programme-specific requirements may be communicated separately.

11.3 Island Sports Personnel may modify or restrict participation where clothing, footwear, jewellery, personal equipment or another item presents a reasonably identified safety risk.

11.4 Where protective equipment is required for a particular activity, participation may be restricted until suitable equipment is available.

11.5 Participants must use Island Sports and venue equipment only as instructed.

12. HEALTH, ALLERGIES & MEDICAL INFORMATION

12.1 Parents/Guardians must provide Island Sports with relevant information concerning a participant's:

medical conditions;
allergies;
injuries;
disabilities or additional needs;
medication;
emergency medication;
prescribed medical devices; and
any other circumstance reasonably relevant to safe participation.

12.2 Information must be provided before participation and updated promptly if circumstances change.

12.3 Parents/Guardians are responsible for determining whether their child is medically fit to participate and should obtain professional medical advice where appropriate.

12.4 A participant who is contagious or otherwise not reasonably fit to participate should not attend.

12.5 Island Sports may reasonably modify or restrict participation where information available to it indicates that participation would present a material safety concern.

13. MEDICATION, FIRST AID & MEDICAL EMERGENCIES

13.1 Island Sports Personnel do not routinely administer medication unless an appropriate arrangement has expressly been agreed in advance.

13.2 In the event of an accident, illness or emergency, Island Sports Personnel may take reasonable steps appropriate to the circumstances, including:

providing basic first-aid assistance within the competence of available personnel;
contacting the Parent/Guardian or emergency contact;
seeking assistance from school or venue first-aid personnel; and
contacting emergency services.

13.3 Where urgent assistance is reasonably considered necessary and a Parent/Guardian cannot immediately be contacted, Island Sports may seek appropriate emergency medical assistance for the participant.

13.4 Nothing in these Terms requires Island Sports Personnel to provide medical treatment outside their training, competence or authority.

13.5 Parents/Guardians remain responsible for ensuring that medication and medical equipment supplied for a participant are current, appropriately labelled and accompanied by relevant instructions.

14. PRESCRIBED MEDICAL DEVICES & ESSENTIAL ITEMS

14.1 Island Sports distinguishes essential medical or health-related items from ordinary personal belongings.

14.2 Parents/Guardians must notify Island Sports where a participant requires an essential item, including where relevant:

prescription glasses;
inhalers;
adrenaline auto-injectors;
hearing devices;
diabetes-management equipment; or
other prescribed or medically necessary equipment.

14.3 Where an essential item needs to be temporarily removed, Island Sports will use the designated medical or essential-item procedure applicable to the programme or venue.

14.4 Coaches should not ordinarily carry participants' belongings on their person while actively coaching or supervising children.

14.5 Emergency medication requiring immediate accessibility will be dealt with according to the applicable programme, venue and emergency arrangements.

14.6 Parents/Guardians must provide any information or instructions reasonably necessary for the appropriate handling and accessibility of essential medical equipment.

14.7 Essential medical items are not treated as ordinary valuables for the purposes of Section 15.

15. PERSONAL BELONGINGS

15.1 Participants should bring only belongings reasonably required for the programme and should clearly label important items where practicable.

15.2 Ordinary personal belongings and valuables are brought to programmes at the participant's own risk.

15.3 Island Sports and Island Sports Personnel do not guarantee against accidental loss, theft or damage to personal property.

15.4 Nothing in this section excludes or restricts liability arising from circumstances for which liability cannot lawfully be excluded or restricted.

16. SAFEGUARDING & CHILD WELFARE

16.1 Island Sports is committed to providing an environment in which children's safety, welfare and wellbeing are appropriately protected.

16.2 Island Sports Personnel are expected to comply with applicable safeguarding, child-welfare and incident-reporting procedures.

16.3 Safeguarding concerns should be reported promptly through Island Sports' designated reporting arrangements.

16.4 Where a safeguarding or welfare concern arises, Island Sports may take reasonable and proportionate action to protect a child.

16.5 This may include communication or referral to a Parent/Guardian, school, venue, emergency service, relevant authority or other appropriate person or organisation.

16.6 Safeguarding responsibilities are separate from the sporting-risk acknowledgement contained in these Terms.

16.7 Nothing in these Terms or the Participant Risk Acknowledgement excludes, restricts or is intended to exclude or restrict any safeguarding responsibility or other liability that cannot lawfully be excluded.

17. TOILETING, CHANGING & PERSONAL CARE

17.1 Toilet, changing and personal-care arrangements will be managed according to participant age, programme environment, venue requirements and applicable safeguarding procedures.

17.2 Parents/Guardians must inform Island Sports in advance of relevant additional support requirements.

17.3 Programme-specific arrangements may apply, particularly for swimming, camps and younger participants.

18. SCHOOL PROGRAMMES & THIRD-PARTY VENUES

18.1 Island Sports delivers programmes at schools, swimming pools, sports facilities, parks and other third-party venues.

18.2 Participants and accompanying adults must comply with applicable venue safety, security and conduct requirements.

18.3 When Island Sports operates on a school campus, the school's applicable safeguarding, child-protection, emergency, security and site requirements apply alongside Island Sports' own procedures.

18.4 Where there is a conflict concerning safeguarding or site safety while Island Sports is operating on school premises, Island Sports Personnel will follow the applicable requirements and directions of the school, subject to applicable law and the need to take reasonable steps to protect a child from immediate harm.

18.5 Relevant information may be shared with a host school or venue where reasonably necessary for safeguarding, safety, emergency response or incident management, subject to applicable privacy requirements.

18.6 Island Sports does not necessarily own, operate or control third-party venues. Responsibility for a venue-related matter will depend upon the circumstances, including the respective control and responsibilities of Island Sports and the venue operator.

19. ARRIVAL, HANDOVER, SUPERVISION & COLLECTION

19.1 Parents/Guardians are responsible for ensuring participants arrive at and are collected from the correct location at the appropriate time.

19.2 Island Sports assumes supervision responsibility only from the designated programme start or handover point and once the participant has been appropriately handed over where supervised handover applies.

19.3 Participants should not be left unattended before Island Sports has accepted responsibility for supervision.

19.4 Island Sports' responsibility for supervision ends when the participant has been appropriately collected or released in accordance with the applicable programme arrangements.

19.5 Island Sports may require authorised collection details for camps, school programmes, younger children or other programmes where reasonably necessary.

19.6 Where a Parent/Guardian is unexpectedly delayed, they must contact Island Sports as soon as reasonably practicable.

19.7 Children awaiting collection will be supervised in accordance with the applicable late-collection procedure.

19.8 Repeated or significant late collection may result in reasonable additional charges, restrictions or alternative arrangements communicated to the Parent/Guardian.

20. FOOD, DRINK, HYDRATION & BREAKS

20.1 Where food or drinks are required, Parents/Guardians remain responsible for supplying suitable items unless Island Sports expressly states otherwise.

20.2 Parents/Guardians must disclose relevant allergies, dietary medical requirements and other health-related considerations.

21.1 Participants are expected to follow reasonable coaching, safety and venue instructions.

21.2 Behavioural concerns will, where reasonably practicable, be managed in an age-appropriate and proportionate manner.

21.3 A participant may be temporarily removed from an activity where reasonably necessary to protect their safety or the safety of others.

21.4 Serious or persistent conduct creating a material safety, safeguarding or operational risk may result in suspension or termination of participation following appropriate communication with the Parent/Guardian.

22. PARENT, GUARDIAN & SPECTATOR CONDUCT

22.5 Serious or repeated inappropriate conduct may result in spectator restrictions or termination of future bookings where reasonably necessary.

23. COACHES, STAFFING & PROGRAMME CHANGES

23.1 Island Sports may substitute coaches or other Island Sports Personnel where reasonably necessary.

23.2 Unless expressly agreed as part of a particular service, a booking does not guarantee a specific coach.

23.3 Island Sports may reasonably modify activities, equipment, coaching format or programme content according to age, ability, safety, participant needs, venue conditions, weather, group size or other operational considerations.

23.4 Published schedules and activity plans are intended as guidance and may be adapted where reasonably appropriate.

26.4 Marketing consent will be requested separately from mandatory acceptance of these Terms.

26.5 A Parent/Guardian may decline marketing consent without affecting the participant's eligibility to participate.

26.6 Consent may be withdrawn for future marketing use by contacting Island Sports. Withdrawal does not affect processing or publication that was lawful before withdrawal, subject to applicable law.

27. PRIVACY & PERSONAL DATA

27.1 Island Sports may collect and use personal information for purposes including bookings, programme administration, communication, participant safety, safeguarding, emergency response, payment administration and other legitimate operational requirements.

27.2 Personal information will be handled in accordance with the Island Sports Privacy Policy and applicable Hong Kong privacy requirements.

27.3 Relevant information may be shared with schools, venues, professional advisers, service providers, emergency services or relevant authorities where reasonably necessary and legally permitted.

27.4 Parents/Guardians should refer to the separate Island Sports Privacy Policy for further information.

29.2 The Parent/Guardian acknowledges that participation in sport and physical activity involves inherent and ordinary risks which cannot be completely eliminated through reasonable coaching, supervision and safety precautions.

29.3 To the extent permitted by law, Island Sports and Island Sports Personnel shall not be liable merely because a participant suffers injury, loss or damage arising from an inherent risk of an appropriately organised sporting or physical activity where reasonable care has been exercised.

29.4 Nothing in these Terms constitutes a guarantee that sporting or physical activities will be free from accident or injury.

29.9 Any responsibility or liability will depend upon the particular circumstances, including:

the nature and inherent risks of the activity;
participant age and ability;
information provided to Island Sports;
reasonable instructions provided by Island Sports Personnel;

32.1 Island Sports may update these Terms periodically to reflect changes in programmes, operations, safeguarding requirements or applicable law.

32.2 The version applicable to a booking will ordinarily be the version presented and accepted when the booking is made, except where a subsequent change is required by law or expressly agreed.

32.3 Island Sports will maintain appropriate version records of its Terms & Conditions.

32.4 Updated Terms will take effect from their stated effective date and will not be retrospectively presented as having applied before that date.
